Kalathia v. PMM, Inc., 2010 WL 4156769 (App. Div. Oct. 25, 2010). The court criticized the failure of the appellant to include in his appendix the contract that was at the center of the case. After the court requested it, the appellant sent in an illegible copy of the wrong document. The court later received the proper document in legible form, but said that the appellant’s failure to comply with the appendix rule, Rule 2:6-1(a)(1), “has disserved our ability to more timely dispose of this appeal and diverted our attention from more fruitful pursuits.”
Even so, it took only 40 days from argument to decision. Perhaps the panel wanted to KO this appeal in a matter of a few days.
