The Supreme Court Takes Up “An Unresolved Issue” Under the No Early Release Act

The Supreme Court announced that it has granted certification in State v. Njango. The question presented there, as phrased by the Supreme Court Clerk’s office, is “Where a person was wrongfully imprisoned beyond the term of incarceration, can prior service credits be applied to reduce the mandatory period of parole supervision under the No Early Release Act, N.J.S.A. 2C:43-7.2?” The Appellate Division, in a published March 5, 2020 opinion (not yet reported other than on LEXIS or Westlaw), which labeled this an “unresolved issue,” held that prior service credits may not be so applied.
