On Friday afternoon, the Supreme Court announced that it had granted review in Kaye v. Rosefielde, 432 N.J. Super. 421 (App. Div. 2013). The opinion of the Appellate Division is discussed here. The question presented, as stated by the Supreme Court Clerk’s Office, is “Did the Appellate Division err by affirming the trial court’s holding that economic damages are a necessary prerequisite for disgorgement of the employee’s salary?”
