The Supreme Court announced this morning that it has granted certification to review Lippman v. Ethicon, Inc., 432 N.J. Super. 378 (App. Div. 2013). The decision of the Appellate Division is discussed here. The question presented, as phrased by the Supreme Court Clerk’s office, is “Can employees who are responsible for monitoring and reporting on employer compliance with relevant laws and regulations– so-called ‘watchdog employees’– seek whistleblower protection under the Conscientious Employee Protection Act (CEPA), N.J.S.A. 34:19-1 et seq., and, if so, under what circumstances?”
