Supreme Court Will Review Another Referendum Case

As discussed here, the Supreme Court already has on its docket Tumpson v. Farina, 431 N.J. Super. 164 (App. Div. 2013), which involves a referendum in a Faulkner Act municipality.  [Disclosure:  My firm, Lite DePalma Greenberg, LLC, represents the municipal parties in that appeal].  The Court has now granted review of another referendum case, In re Petition for Referendum to Repeal Ordinance 2354-12 of West Orange Tp.  The Appellate Division decision in that matter, a per curiam opinion, is available here.  The question presented to the Court in that case, as phrased by the Supreme Court Clerk’s Office, is “Was plaintiffs’ action challenging the municipal redevelopment ordinance time barred and, if not, was the ordinance invalid because of the municipality’s failure to submit an application for approval of the issuance of bonds to the Local Finance Board in the Department of Community Affairs?”
