The Supreme Court announced this morning that it has granted review in Borough of Merchantville v. Malik & Son, LLC, 429 N.J. Super. 116 (App. Div. 2013). The decision of the Appellate Division is discussed here. The question presented, as phrased by the Supreme Court Clerk’s Office, is “Does a condemning municipality have a duty under the Eminent Domain Act, N.J.S.A. 20:3-1 to -50, to engage in bona fide negotiations with a lien holder that has obtained a final judgment of foreclosure on the property subject to condemnation?”
