In Estate of Desir v. Vertus, 418 N.J. Super. 310 (App. Div. 2011), discussed here, the Appellate Division allowed a party who went to help a neighbor with “something going on” at his home office to sue that neighbor when the situation turned out to be a robbery in progress and the plaintiff was shot as a result. The Supreme Court has now granted a petition for certification in this case. Depending on how the Court sees the case, it could be a significant tort law ruling, especially in the areas of duty and foresseability.
Has anyone applied for or been granted amicus status on this matter? The Respondent’s Reply appeared to miss a significant theoretical issue.
